The vital status of patients who are a part of controlled donation after circulatory death (cDCD) is widely debated in bioethical literature. Opponents to currently applied cDCD protocols argue that they violate the dead donor rule, while proponents of the protocols advocate compatibility. In this article, we argue that both parties often misinterpret the moral implications of the dead donor rule. The rule as such does not require an assessment of a donor’s vital status, we contend, but rather an assessment (...) of whether procurement of organs in cDCD cause the death of the donor or not. We then argue that commonly practiced cDCD protocols do not violate the dead donor rule, since the donation does not trigger or cause the death of the donors. (shrink)

What impact should sufficientarianism have on the measurement of inequality? Like other theories of justice, sufficientarianism influences how economic inequality is conceived. For the purpose of measurement, its standards of justice can be approximated by income-based thresholds of sufficiency. At which income level could a threshold of having enough be pegged in OECD countries? What would it imply for standard indicators of inequality, such as decile comparisons of cumulated income, income spreads, or the Gini coefficient? This paper suggests some answers (...) to these questions, showing that sufficientarian ideas could make a difference with respect to the measurement of inequality in a society. (shrink)

It has been argued that Hume's denial of infinite divisibility entails the falsity of most of the familiar theorems of Euclidean geometry, including the Pythagorean theorem and the bisection theorem. I argue that Hume's thesis that there are indivisibles is not incompatible with the Pythagorean theorem and other central theorems of Euclidean geometry, but only with those theorems that deal with matters of minuteness. The key to understanding Hume's view of geometry is the distinction he draws between a precise and (...) an imprecise standard of equality in extension. Hume's project is different from the attempt made by Berkeley in some of his later writings to save Euclidean geometry. Unlike Berkeley, who interprets the theorems of Euclidean geometry as false albeit useful approximations of geometrical facts, Hume is able to save most of the central theorems as true. (shrink)

In a familiar interpretation, the Non-Identity Problem claims that persons whose existence depends on a seemingly harmful action cannot in fact be harmed through such an action. It is often objected that the persons in question can nevertheless be wronged through a violation of their rights. However, this objection seems to fail because these persons would readily waive any violated right in order to come into existence. The present article will analyze this Waiver Counter Argument in detail and show why (...) it does not succeed. First, it is necessary to distinguish between a prospective and a retrospective waiver scenario. In the prospective scenario an imagined person must consider whether she wants to waive a right in order to come into existence. In the retrospective scenario a person is asked whether she would prefer a wronged existence to never having been born. In both scenarios the conditions of a legitimate waiver of rights are not met, but for different reasons. On this basis, an argument against NIP can be developed. (shrink)

David Lewis argued that Newcomb’s Problem and the Prisoner’s Dilemma are “one and the same problem” or, to be more precise, that the Prisoner’s Dilemma is nothing else than “two Newcomb problems side by side” (Lewis Philosophy and Public Affairs 8:235–240, 1979 : 235). It has been objected that his argument fails to take into account certain epistemic asymmetries which undermine the one-problem thesis. Sobel ( 1985 ) acknowledges that many tokens satisfy the structural requirements of both problems, while questioning (...) the generality of the thesis. Bermúdez (Analysis 73:423–429, 2013 ), on the other hand, argues that there is a deeper structural conflict between the two problems in the sense that the epistemic requirements that give Newcomb’s Problem its force are precisely those that prevent it from being a Prisoner’s Dilemma. I argue that the epistemic asymmetry objections raised by Sobel and Bermúdez fail to undermine the one-problem thesis. A different type of objection raised by Bermúdez, one which relies on the contrast between parametric and strategic choices, fares no better. Although NP is a problem that has been primarily studied for its implications to decision theory, it contains enough game theoretic elements to justify the claim that a juxtaposition of two such problems can be thought of as a strategic game. It has been argued that there is a genuine conflict between the views of geometry defended by Hume in the Treatise and in the Enquiry: while the former work attributes to geometry a different status from that of arithmetic and algebra, the latter attempts to restore its status as an exact and certain science. A closer reading of Hume shows that, in fact, there is no conflict between the two works with respect to geometry. Abstractabstract:Cardinal Sforza Pallavicino, SJ (1607–67), conceived a procedure for determining natural moral laws by voting under a veil of ignorance. Behind this veil, imagined possible people who are ignorant of their social position, personal characteristics, nation, and the historical period in which they live vote as equals. These possible people are asked to establish a moral law in pursuit of their own and collective happiness, which they are obligated by God to follow. In Beyond the Limits of Thought [2002], Graham Priest argues that logical and semantic paradoxes have the same underlying structure (which he calls the Inclosure Schema ). He also argues that, in conjunction with the Principle of Uniform Solution (same kind of paradox, same kind of solution), this is sufficient to 'sink virtually all orthodox solutions to the paradoxes', because the orthodox solutions to the paradoxes are not uniform. I argue that Priest fails to provide a non-question-begging method to 'sink (...) virtually all orthodox solutions', and that the Inclosure Schema cannot be the structure that underlies the Liar paradox. Moreover, Ramsey was right in thinking that logical and semantic paradoxes are paradoxes of different kinds. (shrink)

The comment focusses on O'Neill's advocacy of Classical Institutionalism (CI) and the problems of the ideal-regarding approach to the construction of institutions. It maintains that CI shows no signs of progress which would justify a renewed exclusive interest in this paradigm and that the ideal-regarding approach needs some consequentialist balancing to avoid obvious risks of totalitarian denaturation.

Social epistemology existed in the scholastic tradition in the shape of doctrines on the legitimate use of probable opinions. Medieval scholasticism had developed sophisticated approaches in this respect, but the apogee of scholastic theoretical reflection on social epistemology occurred in the Baroque era and its Catholic moral theology. The huge debate on probable opinions at that time produced the most far-reaching and deepest investigations into the moral and epistemological foundations and limitations of opinion-based, reasonable discourse prior to the late twentieth (...) century. It is time to recover the arguments and claims of Baroque scholastic social epistemology, not only to fill a lacuna in intellectual history but also to see whether some of its challenges are still with us today. Daniel Schwartz's book illustrates that moralists, lawyers, political decision makers, and society at large already contended with these issues some four hundred years ago. Deontologists often assume that ethical constraints hold ‘come what may’ but that violations of the constraints can be excused or pardoned. Vinit Haksar has argued for pardon as deontologically appropriate mitigation for the violation of deontological constraints. However, the reasons he adduces against excuse are inconclusive. In this paper, I show how complex the question of excuse versus pardon for deontological transgressions is. Liability for the development of character traits and the assumption of agent-centered responsibility have to be taken into (...) account before the possibility of pardon can be identified as appropriate deontological softener for strict constraints. This paper claims that deontological and consequentialist ethics are best distinguished with reference to different assumptions concerning moral accountability and accounting. Deontological ethics can thereby be defended against the accusation of inordinate concern with the moral purity of agents. Moreover, deontological ethics can and should reject being based on the concept of agent-relative value. Even under the assumption that deontological ethics can be consequentialized, agent-relative value need not play a fundamental role. This is not the same as denying agent-relativity a (...) key role in deontological ethics. Deontological moral accounting of universal value should be regarded as agent-relative, whereas consequentialist accounting assumes a shared moral account of all moral agents. (shrink)

In the history of scholastic philosophy, the fifteenth century is traditionally regarded as a period of decay, a downturn between the heights of fourteenth-century nominalism and the Spanish revival of scholasticism in the sixteenth century. This paper sets out to challenge this received view. First, however, the received view is confirmed on the basis of sixteenth-century lists of ecclesiastical writers containing very few notable scholastic philosopher-theologians for the fifteenth century. On the other hand, the same lists show a significant increase (...) in notable scholastics in the fields of practical ethics and jurisprudence. The overall picture signals a shift of philosophical and theological activity from theoretical towards practical concerns. If practical philosophy is not considered to be of lesser rank than theoretical philosophy, there was thus no downturn of scholastic philosophy in the fifteenth century. (shrink)

Pragmatist Conception of Participatory Democracy1 The paper considers the issue of participatory democracy which has recently got high in the European integration agenda. In the history of ideas, however, it has been a controversial as well as neglected idea associated mostly with Rousseauian and Leftist models of democracy. The autor points to the key features of participatory democracy such as the idea of self-mastery. The philosophical idea of participation lies at the heart of the pragmatist conception of democracy as developed (...) by J. Dewey. Its functioning may be illustrated by the concept of "democratic normative community". This conception of participatory democracy as a broad social rather than a narow political phenomenon provides the framework that makes it both a vital ideal and a creative task for current global as well as local efforts to bring about the sociopolitical change. The paper provides an account of the pragmatist philosophical conception of reciprocity and altruism based on the ontology of “panrelationalism”. The Deweyan concepts of transaction and cooperation are also outlined in some detail as well as the pragmatist (Rortyan) idea of justice. The author attempts to show that altruism is not necessarily just reciprocal but demands as its supplement (at least) altruism without reciprocation.

The "Practice Turn" in the Contemporary Socio-Human Sciences The paper provides an overview of the current situation in the socio-human sciences, which is characterised by attempts to overcome traditional one-sided approaches and look for new alternatives. One of the latest alternatives to traditional approaches in the philosophy and methodology of the social sciences is the "practice turn". It is the turn to another, non-traditional approach to practice but also to Aristotelian phronesis. Timothy Michael Fowler has argued that, as a consequence of their commitment to neutrality in regard to comprehensive doctrines, political liberals face a dilemma. In essence, the dilemma for political liberals is that either they have to give up their commitment to neutrality (which is an indispensible part of their view), or they have to allow harm to children. Fowler’s case for this dilemma depends on ascribing to political liberals a view which grants parents a great degree of freedom in (...) deciding on the education of their children. I show that ascribing this view to political liberals rests upon a misinterpretation of political liberalism. Since political liberals have access to reasons based upon the interests of children, they need not yield to parent’s wishes about the education of their children. A correct understanding of political liberalism thus shows that political liberals do not face the dilemma envisaged by Fowler. (shrink)

Mixed strategies have been used to show that Pascal’s Wager fails to offer sufficient pragmatic reasons for believing in God. Their proponents have argued that, in addition to outright belief in God, rational agents can follow alternatives strategies whose expected utility is infinite as well. One objection that has been raised against this way of blocking Pascal’s Wager is that applying a mixed strategy in Pascal’s case is tantamount to applying an iterated mixed strategy which, properly understood, collapses into the (...) pure strategy of becoming a theist. I argue that since the assumptions used to develop the iterated mixed strategies response are even more questionable than those the initial objection relies on, this type of response to the mixed strategy objection fails. According to John Rawls’s famous Liberal Principle of Legitimacy, the exercise of political power is legitimate only if it is justifiable to all citizens. The currently dominant interpretation of what is justifiable to persons in this sense is an internalist one. On this view, what is justifiable to persons depends on their beliefs and commitments. In this paper I challenge this reading of Rawls’s principle, and instead suggest that it is most plausibly interpreted in externalist terms. On this alternative view, (...) what is justifiable to persons is not in any way dependent on, or relativized to, their beliefs and commitments. Instead, what is justifiable to all in the relevant sense is what all could accept as free and equal. I defend this reinterpretation of the view by showing how it is supported by Rawls’s account of the freedom and equality of persons. In addition, a considerable advantage of this suggestion is that it allows for an inclusive account of to whom the exercise of political power must be made justifiable. (shrink)

In the spring of 1956, a comprehensive inventory of the manuscripts from Qumran Cave 4 was prepared which established the manuscript assignments for each of the members of the first editorial team. The manuscripts numbered 4Q521-4Q579 were assigned to Jean Starcky. Unfortunately Père Starcky died before publishing his allotment, which included primarily parabiblical and pseudepigraphic compositions in Hebrew or Aramaic. Though quite amorphous in character, the group reflects the interest in biblical themes and liturgy characteristic of Second Temple period Judaism. (...) In this volume, Émile Puech presents a critical text edition of the Hebrew manuscripts from this corpus.
